Professionals that provide a service need to purchase professional liability insurance. This coverage is also known as errors and omissions for most professionals, and medical malpractice insurance for health providers such as doctors and nurses. When a suit is filed, the plaintiff (suing party) can be awarded damages based on economic loss.
For example: A surgeon makes a mistake in surgery and it costs the patient $200,000 in time loss from their job. This is the amount of money the patient can recover for economic damages. There are also punitive damages which are meant as a punishment. If the surgeon acted recklessly or with bad intent, those damages can be millions of dollars, in addition to the $200,000. This example applies to any professional field, from engineers, to architects, to attorneys, etc.
Professional liability is very cost prohibitive; in particular, medical malpractice insurance can be very expensive. This is not only due to legitimate economic claims, but also to illegitimate claims that seek easy money and fast settlements. These are often plaintiff attorneys who work on a contingency basis. In California, the Medical Injury Compensation Reform Act, or MICRA, was passed, which limits punitive damages to $250,000, helping lower the cost of medical malpractice insurance.
